Liberal fear and, well fear!





Randall Kennedy is your typical Harvard liberal.  He is a professor in the Law School, a position unattainable for a conservative.  Now, he is afraid.  Very afraid.

What is he afraid of?

He is afraid of the 2012 election and fears that the great liberal hope, Barack Obama will be fired by the American people.  He sees the handwriting on the wall.  Americans do not like socialists or socialism.  He also knows we have a chance to break the back of socialism.  In 2012, we will take control of both houses of congress.  Unless the Republicans do their usual snatching defeat from the jaws of victory, we will have the White House.  We currently have a 5-4 majority on the Supreme Court, most of the time.

That could change.

One of the reasons this election is so important is the potential openings on the Supreme Court in the next few years.  Randall Kennedy wants liberal justices Breyer and Ginsburg to retire now, so Obama can name their replacements. 

The good news with that theory is we are close enough to an election, the GOP would hold out and the nominee would never get a vote.  The other good news is neither Ginsburg nor Breyer seem inclined to take Kennedy’s advice.

Breyer is 72.  Ginsburg is 78 and is believed not to be in good health.  Kennedy fears that if a Republican is elected in 2012, one or both of them could not make it through two terms.   There is good news there and that is why this election is so important on a number of fronts.  Right now, there is a slight 5-4 conservative majority on the Court.  By appointing Kagen and Sotomayor, Obama was able to put two liberals on the Court that will probably be there for thirty years.  If Breyer and Ginsburg were to retire and Obama could replace them, then a four vote solid liberal majority would be established and cemented for thirty years.  Another liberal presidency and the left could have a solid majority on the Court. 

On the other hand, if a good solid conservative wins, and one or both of them go, we have the possibility of shifting the court to 6-3 or even 7-2 conservative.  Assuming the President picked some young candidates and possibly replaced one or two of the older conservative judges, we could establish a conservative legacy on the court that could go until the middle of the century. 

On the other hand, if we cannot defeat Obama or we end up with a RINO, there is no telling what kind of Supreme Court we could end up with. 

As he was leaving office in 1961, Dwight Eisenhower was asked if he had made any mistakes as President.  He said, “Yes, two. And they are both on the Supreme Court.”

The Supreme Court is one of the reasons we in the Tea Party movement need to find a good conservative and come together to support him or her and make sure they become the 45th President of the United States.
